These terms and conditions govern your use of the Reflectal website at reflectal.au (the "website") and, where you have been granted access, the Reflectal sandbox demonstration environment at inside.reflectal.au (the "sandbox"), both operated by Reflectal Pty Ltd (ACN 673 183 205) ("Reflectal", "we", "us" or "our").
By accessing or using the website or the sandbox, you agree to these terms. If you do not agree, please do not use them.
These terms may change
We may update these terms from time to time. The current version will always appear on this page with the date it was last updated. By continuing to use the website after a change, you accept the updated terms.
Use of the website
You may use the website for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of the website by, anyone else. You agree not to misuse the website, including by attempting to gain unauthorised access to it, introducing malicious code, interfering with its operation, or collecting information from it by automated means without our permission.
Access to the sandbox
Where we grant you access to the sandbox, including any demonstration or client dashboard environment, that access is personal to you. You must keep your sign-in details secure, must not share them or make your access available to anyone else, and must not attempt to reach areas you have not been given. We may change, suspend or withdraw sandbox access at any time without notice.
The sandbox is confidential
The sandbox and everything in it, including its design, features, question sets, dashboards, scoring and reporting, is commercially sensitive and confidential information belonging to Reflectal. By accepting access you agree not to disclose, share, copy, photograph, screenshot, record or demonstrate any part of it to any other person or organisation without our prior written permission, and not to use anything you see in it for any purpose other than evaluating Reflectal. These obligations continue after your access ends.
Sandbox data is illustrative only
All data shown in the sandbox, including organisations, people, scores, trends and comments, is fictitious and is provided for illustration only. It does not describe any real organisation or person, and it must not be relied on for any decision.
Our intellectual property
Unless stated otherwise, all content on the website, including text, graphics, logos, the Reflectal name and brand, images and design, is owned by or licensed to Reflectal and is protected by intellectual property laws. You may view and print content for your own information, but you must not copy, reproduce, republish, distribute or use it for any commercial purpose without our prior written permission. The Reflectal platform and the sandbox, including their design, methods, question sets, dashboards, software and data models, are also the intellectual property of Reflectal, and access to the sandbox gives you no licence or other rights over any of it.
Information on the website is general only
The information on the website is provided for general information purposes only. It is not professional, legal, medical or psychological advice, and you should not rely on it as a substitute for advice from a qualified professional. While we take care to keep the information accurate and current, we do not guarantee that it is complete, accurate or up to date.
Availability and no warranties
We provide the website on an "as is" and "as available" basis. We do not warrant that the website will always be available, uninterrupted or free of errors, and we may change, suspend or withdraw all or part of it at any time without notice.
Our liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law, Reflectal is not liable for any loss or damage arising from your use of, or inability to use, the website, or from reliance on any content on it. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the relevant information or paying the reasonable cost of having it re-supplied.

Governing law
These terms are governed by the laws of Western Australia, Australia. You and Reflectal submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts able to hear appeals from them.
General
If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a right under these terms is not a waiver of that right. These terms, together with our privacy policy, are the entire agreement between you and us in relation to your use of the website and the sandbox.
